1. Agreement to These Terms

Prompt Wars is operated by Patryk Domasik, doing business as Prompt Wars ("Company," "we," "us," or "our"). We are registered in Poland at Karmelicka 5/5, Krakow, Malopolskie 31-133, Poland. Our VAT number is PL9452241936.

By accessing or using Prompt Wars, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, you must not access or use the Services.

2. Our Services

Prompt Wars is a competitive AI prompt-battle game for iOS and Android. Players create characters, enter prompt battles, submit written prompts under shared themes, receive AI-assisted judging, and may view cinematic AI-generated or AI-assisted battle reveals.

The Services include the Prompt Wars mobile application, the website at promptwars.gg, waitlist and email forms, game accounts, battle systems, ranking and progression features, virtual credits, subscriptions, support channels, moderation tools, and any related products or services that link to these Terms.

We may update, suspend, remove, or change any part of the Services at any time, including game balance, scoring rubrics, features, credits, subscription benefits, and availability by region or platform.

3. Eligibility and Age Requirement

The Services are intended only for users who are at least 18 years old. Persons under 18 are not permitted to use or register for Prompt Wars.

By using the Services, you represent that you are at least 18 years old, have the legal capacity to agree to these Terms, and will comply with applicable laws.

4. Accounts and Registration

You may need an account to use the mobile app and participate in battles. You agree to provide accurate, current, and complete account information and to keep it updated.

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly if you believe your account has been compromised.

We may suspend or terminate accounts that provide false information, violate these Terms, attempt to manipulate rankings, abuse other users, evade moderation, or create security or integrity risks.

5. AI Judging, Generated Content, and Game Outcomes

Prompt Wars uses generative AI and AI-assisted systems to judge battles, compose result payloads, produce optional cinematic reveals, moderate content, and support gameplay. AI systems can be imperfect, inconsistent, delayed, or unavailable.

Battle outcomes may depend on prompts, themes, move types, scoring rubrics, automated judging, tie-breakers, moderation status, appeal rules, and game balance systems. We do not guarantee that any score, ranking, match, reveal, or AI-generated output will be error-free, uninterrupted, or suitable for every user.

Battles are judged, and result videos produced, by generative AI. You should not rely on Prompt Wars output as factual, professional, legal, medical, financial, or safety advice.

We may rerun, reverse, adjust, remove, or refuse a battle result, ranking change, reward, credit transaction, reveal, or generated asset if we believe there was abuse, technical failure, moderation failure, provider error, payment issue, or other integrity concern.

6. Your Prompts, Characters, and Other Content

You may create, submit, upload, display, or transmit prompts, character names, battle cries, profile information, reports, messages, images, feedback, and other materials through the Services ("User Content").

You retain any rights you have in your User Content. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify, create derivative works from, display, perform, publish, distribute, moderate, analyze, and otherwise use that User Content to operate, improve, promote, secure, and provide the Services.

You represent that you have all rights necessary to submit your User Content and that it does not violate the rights of any third party or any applicable law.

Feedback, suggestions, ideas, or comments you send us may be used by us without restriction or compensation to you.

7. Intellectual Property Rights

We own or license the Services, including source code, game systems, designs, text, graphics, audio, video, animations, software, databases, trademarks, service marks, logos, and other materials, excluding User Content you submit.

Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial entertainment purposes.

You may not copy, sell, license, scrape, reverse engineer, modify, exploit, or create competing products from the Services except as expressly allowed by law or by our written permission.

8. Purchases, Credits, and Subscriptions

Prompt Wars may offer optional purchases, including virtual credits, cosmetics, AI video reveals, subscriptions such as Prompt Wars+, and limited-time offers. Purchases do not provide paid stat boosts, paid scoring modifiers, or paid archetypes.

Mobile purchases are processed by the Apple App Store, Google Play, RevenueCat, or other payment providers. Your purchase is also subject to the applicable store terms and payment provider terms.

Subscriptions automatically renew unless canceled before the renewal date through the applicable app store or platform account settings. Deleting the app or deleting your account may not cancel a subscription. You are responsible for managing cancellation through the platform where you purchased it.

Virtual credits, entitlements, cosmetics, and reveal upgrades are limited licenses for use in the Services. They have no cash value, are not property, cannot be redeemed for money, and may not be sold, transferred, traded, or exchanged outside Prompt Wars.

Except where required by law or app store rules, purchases are final and non-refundable. We may automatically refund credits or restore entitlements when a provider failure, moderation rejection, or technical issue prevents a purchased feature from being delivered.

9. Prohibited Activities

You agree not to use the Services to:

• submit illegal, exploitative, hateful, sexually explicit, harassing, threatening, violent, self-harm, or otherwise unsafe content;
• impersonate another person, misrepresent your identity, or infringe intellectual property, privacy, publicity, or other rights;
• collude, win-trade, manipulate ratings, exploit bugs, automate gameplay, farm accounts, or interfere with fair matchmaking;
• harass, abuse, threaten, dox, stalk, or target other users;
• bypass, disable, or interfere with safety, moderation, payment, entitlement, security, or access-control systems;
• upload malware or attempt unauthorized access to accounts, systems, networks, data, or providers;
• scrape, harvest, sell, or misuse data from the Services;
• use the Services for unlawful, commercial, political persuasion, spam, or deceptive purposes without our written permission.

10. Moderation, Reports, and Enforcement

We may review, reject, remove, blur, quarantine, label, downrank, restrict, or report User Content, generated content, accounts, battles, profiles, or shared materials when we believe they violate these Terms, law, platform policies, provider rules, or community safety expectations.

We may use automated moderation, human review, user reports, provider safety tools, and account integrity systems. Moderation decisions may affect battle resolution, credit refunds, rankings, rewards, subscription benefits, or account access.

If you see content or conduct that appears to violate these Terms, please report it in the app where available or contact us at hello@promptwars.gg.

11. Third-Party Services

The Services may rely on or link to third-party services, including Supabase, RevenueCat, Apple, Google, Expo, AI model providers, moderation providers, analytics providers, email providers, and hosting providers.

We are not responsible for third-party services, content, policies, outages, billing systems, or security practices. Your use of third-party services may be subject to their own terms and privacy policies.

12. Privacy

Please review our Privacy Policy, which explains how we collect, use, disclose, and protect personal information. By using the Services, you agree that we may process information as described in the Privacy Policy.

13. Service Availability and Changes

We aim to keep Prompt Wars available, but the Services may be interrupted, delayed, changed, or discontinued due to maintenance, provider failures, network issues, app store review, legal requirements, abuse prevention, business needs, or events outside our control.

We do not guarantee that the Services, any battle, any AI provider, any generated reveal, or any feature will be available at all times or in every location.

14. Termination

We may suspend, restrict, or terminate your access to all or part of the Services at any time if we believe you violated these Terms, created risk for other users or the Services, infringed rights, abused purchases, or engaged in unlawful activity.

You may stop using the Services at any time. Sections that by their nature should survive termination will survive, including intellectual property, User Content licenses, purchases, disclaimers, limitation of liability, indemnification, and dispute provisions.

15. Disclaimers

The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, security, and uninterrupted operation.

We do not warrant that AI judging, generated content, moderation, rankings, purchases, provider integrations, or gameplay systems will always be accurate, fair, complete, safe, or error-free.

16. Limitation of Liability

To the fullest extent permitted by law, we and our directors, employees, contractors, agents, partners, and affiliates will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost revenue, loss of data, loss of goodwill, service interruption, or damages arising from your use of or inability to use the Services.

To the fullest extent permitted by law, our total liability for any claim relating to the Services will be limited to the amount you paid us, if any, during the three months before the event giving rise to the claim.

17. Indemnification

You agree to defend, indemnify, and hold us harmless from and against claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from your User Content, your use of the Services, your violation of these Terms, your violation of law, or your violation of any third-party rights.

18. Governing Law

These Terms are governed by the laws of Poland, without regard to conflict-of-law principles. If you are a consumer, you may also have mandatory rights under the laws of your country of residence that cannot be waived by contract.

19. Changes to These Terms

We may update these Terms from time to time. The updated version will be indicated by an updated "Last updated" date and will be effective when posted unless a later date is stated. Your continued use of the Services after changes become effective means you accept the updated Terms.
